If you believe that it was the other driver’s fault, collect all your evidence and take it to court. You usually have a few years to file a claims or file a lawsuit. However, since you did not have insurance and that is the law, you may not get anything because you were driving illegally at the time of the accident. But if you have the money for small claims court (usually just a couple hundred dollars), I would say it is at least worth a try. Or talking to an attorney is always free. See what type of case you can build.

The crash sensors are IN THE FRONT OF THE CAR right where they were working. If they goofed up anything, especially wires, it’s very possible for them to deploy. You might have to take it to an independent shop to verify this.

First thing I would do is to write your state’s Commissioner of Insurance. Tell him her everything you know about this, and your insurance and the other insurance company.

There is absolutely nothing that will get you a quicker response from an insurance company than a letter from the insurance commissioner.

The insurance commissioner has the authority to shut down any insurance company that does business within the state. And if you car insurance is with a company that also writes life and medical and property, etc. they must cease signing up new business until the commissioner is satisfied they have treated you according to their contract with you. Insurance companies do not like getting letters from the commissioner; it puts their business in jeopardy, and is a great impetus to make them treat you right.

I am wondering where your agent is in all this? Agents are not all created equal; there are good ones and lazy ones. But with a good agent, you should not even need a lawyer.

And I think you have got a shyster for a lawyer. He probably decided that the part you settled made him the most money, and he’s not willing to put in the time to work for the little that’s left.

And another thing. Lawyers really like to take a case where you do not pay their fee up front, and let them take a third of the settlement. Unless a claim is less than ten thousand, never let a lawyer take your case on contingency. If he wins, he takes his expenses and court costs out first, then takes a third of what’s left for his fee, and you wind up with about 40% of the total award. It’s better to bite the bullet and pay up front.

You are obligated by federal law to file a tax return. All of your rental income must be reported. If you fail to file, there is no statute of limitations. The government can come after you ANY TIME. You are not obligated to deduct the interest or other expenses. But it is in your best interest to do so, to bring your tax liability down. You can also deduct insurance, property taxes, repair costs etc.

I told you in your other question that the earnings limit was $8200 before you had to file. This is one of those exceptions I mentioned. Even if you have a loss, you are obligated to file. Trust me, the Internal Revenue Service is not an organization you want to screw with.

You still might be entitled to a refund if your facts are true and complete. It is not illegal to live off of your savings.

If you end up in a law suit based on your accident they will probably require you to produce your tax returns.

Discovered dealer ask shady mechanic to ck virtually all fluids tires before I left. Power steering fluid shld be sealed not need replacing is now empty, bad run flat tire, bonnet & quarter panel molding have a part # instead VIN, poor oil, more. They claim 100% satisfaction on the website. If they won’t make good on devalue involving car or decide to buy it back can i make sure it again costs them inside lost sales incredibly more than the valuation of my automotive. If your employer paid the premiums, yes the benefits are taxable income to you and you should have gotten a W-2. If you had paid the premiums, then the benefits wouldn’t be taxable. Contact Principal Insurance or your employer.

Not sure about Cali, but the other post was pretty accurate. Usually the company has a threshold. Could be 500, could be 1000, could be anything. Could be that your rate is not “surcharged” but you lose something like a good driving (claims free) discount, which is just about the same as a surcharge, either way your rates go up. There’s nothing out there published because it’s all based on guidelines for the company’s underwriting dept.

You don’t want or need a lawyer (yet). State Farm will be offering you a settlement. If you don’t accept or can’t negotiate a better settlement, you can THEN hire a lawyer. A lawyer will take a third plus expenses and will likely end up with more that you get.
